Cleveland, Titusville and Washington, 1862 to 1911. An American railroad was a common carrier, and a common carrier was supposed to serve all comers alike — but no federal body existed to say what that meant, no state had settled what a corporation was permitted to be, and the rate a shipper actually paid was a private treaty. Into that opening John D. Rockefeller and Henry Flagler wrote contracts. A rebate returned part of a published freight rate to a favored shipper. A drawback paid that shipper part of what a rival had paid on his own oil. Neither was plainly criminal when it was written. Both became, inside thirty years, the reason for a federal commission, an antitrust statute, and a decree dissolving the largest company in the country. Covers John D. Rockefeller, Henry Flagler, Standard Oil, and South Improvement Company.
